2022年9月1日起劳工法令不再受2000令吉薪金以下的限制而是涵盖所有员工

2022年9月1日起劳工法令(第一附表)修正生效,重点是“所有服务契约的员工”将取代“2000令吉以下的员工”,意味着9月1日起劳工法令的约束不再受2000令吉薪金以下的限制而是涵盖所有员工。

不过,修正案也阐明4000令吉薪金以上的员工,不适用于法令的60(3),60A(3),60C(2A), 60D(3),60D(4)和60J条款。简单来说公司需要为4000令吉以下的员工做出超时工作(Overtime)福利和解雇与退休福利。

Starting 1st September 2022, Employment Act 1955 No Longer Limit By Wages RM2000 but It Will Cover All Employees
Starting 1st September 2022, The Employment Act 1955 is amended in the First Schedule. Highlight is replacement of “Employee with wages RM2000“ by “Any person who has entered into a contract of service”. Meaning starting 1st September 2022 , Employment Act no longer limit to employee wages below RM2000, but it will cover all employees.  But, the provision of the amended act also stated that for Employee whose wages exceeds four a month is not applicable for Subsections 60(3), 60A(3), 60C(2A), 60D(3) and 60D(4) and section 60J. In another word, company need to pay employees with wages below RM4000 for Overtime benefits, lay-off/termination benefits and also retirement benefits.
